בטל ב-61 בע״מ, ח.פ. 515788677, מרח' אסתר המלכה 4 תל אביב, ישראל ("אנחנו", "אנו", "שלנו") מציעה שירותי החלפה של שקלים - לקריפטו וההיפך דרך מסוף כספים אוטומטי (כספומט) כמתואר להלן ("השירות"). השירות מוצע בכפוף להסכמתך לתנאים ולהגבלות המפורטים בזה להלן ("תנאי השימוש") וכן לכל הסעיפים הרלוונטיים במדיניות הפרטיות של החברה.

הנך מאשר ומסכים שייתכן שחשבון הלקוח יושבת בעקבות בקשתך בכתב לבטלו (בהנחה שהושלמה כל פעילות נוכחית בחשבון).
אתה אחראי לאבטחת שם המשתמש והסיסמה שלך ו/או קוד סודי/12-24 מילים לחשבונך ולארנק שלך, ולא תעביר אותם לצד שלישי כלשהו. אנו לא מחויבים לשמור על שם המשתמש והסיסמה שלך ו/או קוד סודי/גיבוי. אם תאבד או תשכח את הסיסמה או את שם המשתמש שלך מכל סיבה שהיא מלבד טעות שלנו, לא נישא באחריות לאובדן ישיר או עקיף כלשהו, הקשור למקרה כאמור.

איננו אחראים לשום אובדן או נזק הנובעים מכך עמדתם בהתחייבויות האמורות לעיל.

השירותים ניתנים כעסקת מזומן באמצעות כספומט ביטקוין. על מנת להשתמש בכספומט הביטקוין, תצטרך להפקיד מזומן ולקבל את מטבעות הקריפטו אשר רכשת ישירות אל הארנק הפרטי שלך.
על מנת לבצע מכירה של הנכסים הדיגיטליים, עליך להיות בעל חשבון לקוח וארנק דיגיטלי/ארנק חומרה פרטי משלך.
שים לב כי מכירת נכסים דיגיטליים חייבת להיעשות על ידי שימוש בארנק הדיגיטלי/ארנק החומרה הפרטי שלך בלבד, ללא מעורבות צד שלישי אחר כלשהו (בורסה, משמורת וכו').
בעת שימוש באחד השירותים, עליך לוודא שיש לך ארנק תקף וניתן לתפעול. איננו ולא נהיה אחראים לכל נזק או הפסד ביחס לארנק שלך או לנכסים הדיגיטליים שלך. אתה לבדך נושא באחריות לאבטחתם ולשלמותם של הארנקים שלך. איננו אחראים לנכסים דיגיטליים שנשלחו לכתובת ארנק שגויה/לרשת בלוקצ'יין שגויה, כל עוד התשלומים הועברו לכתובת שסופקה על ידך.
אנו לא נותנים כל ייעוץ או שירות בכל הקשור לספקי ארנק או ארנקים כלשהם, ולא נישא בכל אחריות מכל סוג שהוא בנוגע להפעלת הארנק שלך או לאמצעי האבטחה שננקטו (או שלא ננקטו) על ידך בכל הנוגע לארנק שלך. וכל המלצה לכאורה המתייחסת לארנק כלשהו לא תיחשב להמלצה או לאישור תחת כל נסיבות שהן.
השירותים מסתיימים לאחר העברת נכסי הקריפטו/שקלים. אתה מבין שסיום העסקה עשוי להימשך עד 24 שעות עקב עומסים ברשת הבלוקצ'יין אשר אינם בשליטת החברה.

הנך מצהיר ומתחייב כי לשונו של תנאי שימוש זה ברורה ומובנת לך.
עליך לשפות ולפטור מאחריות אותנו ואת הדירקטורים, נושאי המשרה, בעלי המניות, העובדים, היועצים, הקבלנים, החברות הבנות שלנו והגופים הקשורים אלינו מפני כל התביעות, הנזקים, ההפסדים, ההתחייבויות, הפגיעות, הקנסות, התביעות, התובענות, ההליכים, התשלומים החלים במישרין או בעקיפין, שכר טרחת עורכי דין והוצאות משפט (בין אם בפועל ובין אם מותלות) הנובעים מ: (1) הפרת תנאי השימוש שלך; (2) כל מעשה או מחדל שלך בקשר לתנאי השימוש; ו/או (3) הליכים משפטיים כלשהם שנפתחו נגדנו על ידי צד שלישי כלשהו או מטעמו, כתוצאה של מעשיך או מחדליך או בקשר אליהם, בנוגע להפרת תנאי השימוש שלך.
כל הגורמים המתייחסים לאתר ו/או לשירותים, לרבות אך לא רק בקשר למידע, לנתונים, לתוכנות, לצילומים, לגרפים, לסרטונים, לגופנים, לגרפיקה, למוזיקה, לצלילים ולחומר אחר ("הקניין הרוחני") הינם הקניין הרוחני הבלעדי שלנו ושל הגופים הקשורים בהתאם לשיקול דעתנו. אלא אם קיבלת אישור מפורש או רישיון בכתב מאתנו, אינך רשאי להעתיק, לשנות, להסיר, למחוק, להוסיף, לפרסם, לשדר, להשתתף בהעברה או מכירה, חכירה או השכרה, יצירה של יצירות נגזרות כדי להשתמש בחלק כלשהו מן התוכן של הקניין הרוחני, כולו או חלקו.
אנו שומרים לעצמנו את הזכות לאסוף מידע אישי ונתונים אישיים במידה הדרושה לניהול חשבונך ו/או לשיפור האתר ו/או השירותים ו/או המידע שאנו שולחים אליך, בהתאם למדיניות הפרטיות שלנו www.bitcoinchange.co.il/privacy-policy. ניתן לשלוח את המידע לצדדים שלישיים המשתתפים במתן השירותים הניתנים לך. מידע ונתונים אלו נשמרים גם למטרות אבטחה וכדי לעמוד בהתחייבויות משפטיות ורגולטוריות.
אתה רשאי להגיש שאלות, הערות, הצעות, רעיונות, תוכניות, הערות, שרטוטים, חומרים מקוריים או יצירתיים או מידע אחר אודותינו, אודות האתר ו/או השירותים ("הצעות"). אתה מבין שהצעות כלשהן שיוגשו לנו בדרך של תקשורת לא תהיינה סודיות ויהפכו לקנייננו הבלעדי. נהיה הבעלים של זכויות בלעדיות, לרבות כל זכויות הקניין הרוחני, ונהיה זכאים לשימוש והפצה ללא הגבלה של כל הצעה לכל מטרה, מסחרית או אחרת, ללא כל הודעה ו/או פיצוי כלפיך.

הנך מסכים לציית לכל החוקים החלים בעת השימוש באתר ו/או בשירותים שלנו.
הנך מסכים שתנאים אלה יוסדרו על פי דיני מדינת ישראל בלי להתחשב בהוראות כלשהן של התנגשות דינים.
הנך מסכים באופן בלתי חוזר להיות כפוף, לטובתנו, לסמכות השיפוט הבלעדית של בתי המשפט בתל אביב לצורך יישוב כל תביעה, מחלוקת או עניין הנובעים או הנוגעים לתנאי השימוש או לאכיפתם ואתה מוותר על כל התנגדות לניהול הליכים בבתי משפט כאמור מטעמי סמכות מקומית או בטענה שההליכים הוגשו בפורום שאיננו נוח.
אנו שומרים לעצמנו את הזכות לשנות או לתקן את תנאי השימוש הללו בכל עת לפי שיקול דעתנו, והמשך השימוש שלך באתר ו/או בשירותים יותנה בתנאי השימוש התקפים במועד שבו עשית שימוש באתר ו/או בשירותים. אנו מציעים לך לבדוק באופן קבוע את הגרסה העדכנית ביותר של תנאי השימוש.

The Service is offered subject to Your acceptance of the terms and conditions as set forth herein below (the “Terms of Use”) as well as any relevant sections of the Privacy Policy. Thank you for visiting our website www.bitcoinchange.co.il (the “Website”) and/or one of our physical branches (the “Branch”).
By Your use of the Services in the Website or in one of Our Branch, you agree to the Terms of Use. Please read them carefully. You agree that you are accessing the Services on the Website for business purposes. In order to use the Services, you are required to register and open an account ("Account"). You acknowledge and agree that the Accounts may be deactivated following Your written request to deactivate them (provided that any current activity in the account is completed).
You are responsible for securing your username and password and/or PIN code/12-24 word passphrase for your Account and Wallet, and you shall not transfer them to any third party. We are under no obligation to maintain your user name and password and/or PIN code/backup. If you misplace, forget or lose your password or username because of anything other than Our error, We shall not be liable for any direct or indirect loss associated with such occurrence.
You agree not to impersonate any person, misrepresent any affiliation with another person, entity or association, use false details or otherwise conceal your identity from us for any purpose. You shall notify us immediately upon any change in any of the details you provided to us, or if you are aware of any unauthorized use of your Account. You further agree not to assign, sublicense, transfer, pledge, sell, lease, rent, lend, or otherwise dispose of the Services.
We shall not be liable for any loss or damage arising from your failure to comply with any of the foregoing obligations.
For the avoidance of doubt, We do not, through the entire process, have access to Your funds, Wallet or Account.
The amounts and currencies of the Services are detailed in the electronic invoice You will be provided with to Your email address.
The exchange rate shall be determined upon the completion of the transaction.
Unless otherwise stated in writing with respect to particular Services, We abide by a strict, no refund policy. By accepting the Terms of Use, You agree and understand that you are foregoing the right to claim any refund of fees paid for access and use of the Services.
The services are provided through a cash transaction facilitated via this Bitcoin ATM. In order to use the Bitcoin ATM, You will need to deposit cash with the Bitcoin ATM and get the purchased Bitcoins sent directly to Your Wallet.
In order to execute the Sale of Digital Assets, you must have an Account and your own private digital/hardware Wallet. Note that, selling Digital Assets must be done by using Your private digital/hardware Wallet only, with no involvement of any other 3rd party (Exchange, Custody etc).
When utilizing any of the Services, You must make sure you have a valid and operational Wallet, We are not and will not be responsible for any damages or loss in relation to your Wallet or your Digital Assets. You are solely responsible for the security and integrity of your own Wallets. We not be held responsible for Digital Assets sent to an incorrect Wallet address / wrong Blockchain network or for funds sent to an incorrect bank account, as long as the payments were made to the Wallet or account (as applicable) address/number provided by You.
We do not give any advice or service with regards to any Wallet or Wallet providers and it shall not bear any liability of any kind in connection with Your operation of your Wallet or the security measures taken (or lack thereof) by you with respect to Your Wallet, and any perceived recommendation regarding any Wallet shall not be considered a recommendation or endorsement under any circumstances.
The Services are concluded once the crypto assets/fiat are transferred. You understand that the conclusion of a transaction might take up 24 hours due to blockchain-related issues.
Certain further restrictions or specific limitations on the Services may be introduced from time to time, such will be disclosed and explained in the Branch or the Website.
